Sergio Cofferati, in his capacity as President of the Municipal Theatre, is guilty of unconstitutional behavior against employees of the Foundation. Secondo Cofferati, in alcuni casi, in quel teatro era sufficiente che una sola categoria di dipendenti, magari gli addetti alle luci, alcune unità, bloccasse il lavoro di tutti. Col risultato che il danno era massimo per il teatro, mentre alle altre decine di dipendenti doveva essere riconosciuto per intero lo stipendio. In questo modo, aggiunse, diventava molto facile scioperare. Secondo il difensore, Mario Jacchia, il ricorso non stava in piedi, perchè quello che fu fatto dal teatro era stato solo un esercizio di trasparenza.
